Because local safety standards and regulations vary, Grande Kaffe cannot guarantee that our products meet all applicable requirements in each locality. The purchaser assumes responsibility for compliance with such safety standards and regulations in those localities in which the products will be shipped, sold and used.
Limited Warranty: Except as described in our guarantee, there are no express warranties or implied warranties including, but not limited to, merchantability and fitness for a particular purpose. Grande Kaffe shall not be subject to and disclaims: (1) any other obligations or liabilities arising out of breach of contract or of warranty, (2) any obligations whatsoever arising from tort claims (including negligence and strict liability) or arising under other theories of law with respect to products sold or services rendered by Grande Kaffe, or any undertakings, acts or omissions relating thereto, and (3) all consequential, incidental and contingent damages whatsoever.
Exclusion of Warranties/No Warranties Disclaimer: Buyer acknowledges that Seller is not the manufacturer of the products or goods sold. The implied warranties of merchantability and fitness for a particular purpose and all other warranties, express and implied, are excluded from this transaction and shall not apply to the goods sold. In no event shall Seller be liable to Buyer for indirect, special or consequential damages or for loss of anticipated profits on any claim of any kind resulting from any order hereunder.
These terms and conditions shall constitute the entire agreement between Grande Kaffe and the purchaser, and shall be governed by and construed according to the laws of the state of New Jersey and the United States of America. Orders placed constitute an agreement to the above terms.
